Kennealy Supports Senate Republicans’ Call for SJC Advisory Opinion on Legislative Audit

WALTHAM, MA — Today, Massachusetts Senate Republicans sent a letter to Senate President Karen Spilka formally requesting that the Senate seek an advisory opinion from the Supreme Judicial Court regarding the Legislature’s obligation to comply with the audit approved by 72 percent of Massachusetts voters.

Republican gubernatorial candidate Mike Kennealy expressed his full support for the request, stating that the Supreme Judicial Court should provide clarity so the Commonwealth can move forward with implementing the will of the people.

“When 72 percent of Massachusetts voters agree on an issue, that’s not just a suggestion — it’s a mandate,” said Kennealy. “This ballot question was passed overwhelmingly by the people of Massachusetts, and the Legislature — elected to represent those same voters — has an obligation to comply.”

Kennealy criticized Beacon Hill Democrats for raising constitutional concerns about the measure while refusing to seek a definitive ruling from the state’s highest court.

“One of the excuses being offered is that the law may not be constitutional,” Kennealy continued. “If they truly believe that, then they should take the question to the Supreme Judicial Court themselves. The reality is they’ve avoided doing so because they’re afraid the court may rule in favor of the people.”

Kennealy said the continued resistance from legislative leaders undermines transparency and public trust in state government.

“It is an embarrassment that the Legislature is doing everything possible to hide its work from the people it represents, and it is equally troubling that Governor Healey and Attorney General Andrea Campbell are refusing to stand with the voters on this issue,” Kennealy said. “As Governor, I will stand with the people every time. It is long past time to complete this audit and restore transparency and accountability on Beacon Hill.”
